Terms of Service

These terms govern your use of ReferIQ (referiq.net), a referral revenue platform operated by Vantyx Enterprises (“we”, “us”). By creating an account, signing in, or using the service you agree to them. If you use ReferIQ for an organization, you agree on its behalf and confirm you have authority to do so.

The service

ReferIQ helps businesses find demand, route leads to partners, track referrals, calculate commissions, pay partners, and run SEO and advertising programs. Features may change as we improve the service. The service is currently in beta: it may contain errors, and some features are provided without the uptime or support commitments of a generally available product.

Accounts

• Keep your sign-in details and API keys confidential; you are responsible for activity under your account.
• Give accurate information and keep it up to date.
• Tell us promptly at [email protected] if you suspect unauthorized use.

Your data and your responsibilities

• You own the data you put into ReferIQ. You grant us permission to host and process it to provide the service, as described in our Privacy Policy.
• You are responsible for having the right to collect and use the lead and partner information you manage in ReferIQ, including any consent needed to email, text or call people, and for honoring opt-outs.
• You are responsible for complying with laws that apply to your referral program, including disclosure of paid referral relationships and endorsements, and with the terms of any platform you connect (for example Google Ads, Meta, or social networks).

Advertising and AI features

• ReferIQ only spends money on advertising for campaigns you approve, and you are responsible for the resulting charges billed by the ad platform. Review campaigns, budgets and ad copy before approving them.
• AI-generated content, scores and suggestions may be inaccurate. Review them before you publish or rely on them; you are responsible for what you publish or send.
• Performance figures and forecasts are estimates, not guarantees of results.

Partners and payouts

Commissions are governed by the referral agreement between a business and its partner. Payouts are made through Stripe Connect, subject to Stripe’s terms. We calculate and transmit payouts as configured but are not a party to the referral agreement and are not responsible for disputes between businesses and partners, which the dispute tools in ReferIQ are designed to help resolve.

Acceptable use

You may not use ReferIQ to:

• send spam or messages to people who have not consented or have opted out;
• generate fake clicks, leads, referrals or conversions, or otherwise commit fraud;
• break the law or infringe others’ rights;
• probe, overload or interfere with the service, or access it other than through our interfaces and API;
• resell or provide the service to others without our written agreement.

We may suspend accounts that violate these terms or put the service or others at risk.

Fees

Paid plans are billed as agreed when you subscribe or in your order or invoice. Fees are non-refundable except where the law requires otherwise. We will give notice before changing the price of an existing subscription.

Third-party services

ReferIQ connects to services such as Google, Meta, Stripe, Twilio and CRMs. Your use of those services is governed by their terms, and we are not responsible for their availability or actions.

Ending your use

You can stop using ReferIQ at any time and ask us to close your account. We may end or suspend access for breach of these terms or if we discontinue the service, with reasonable notice where practical. After closure we handle your data as described in the Privacy Policy.

Disclaimers and liability

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement. To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim.

Changes to these terms

We may update these terms. We will post the new version here and update the date above, and notify customers of material changes. Continuing to use the service after changes take effect means you accept them.
